Terms of Service

1. Acceptance of Terms
By creating an account or using BidderLIVE, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform. We may update these terms at any time; continued use constitutes acceptance.
2. Eligibility
You must be at least 18 years old to use BidderLIVE. By registering, you represent that you meet this requirement. Some categories (firearms, certain collectibles) may have additional legal requirements depending on your jurisdiction.
3. Account Responsibilities
- • You are responsible for maintaining the security of your account credentials
- • You may not share your account or allow others to bid or list on your behalf
- • You must provide accurate and truthful information at registration and in all listings
- • You must notify us immediately of any unauthorized use of your account
- • We reserve the right to suspend or terminate accounts that violate these terms
4. Bidding Rules
- • All bids are legally binding offers to purchase at the bid price
- • Bids cannot be retracted once placed except in cases of seller misrepresentation
- • Our proxy bidding system will bid automatically up to your stated maximum
- • Shill bidding, bid manipulation, or collusion with sellers is strictly prohibited
- • Winning bidders must complete payment within 48 hours of auction close
- • Failure to pay may result in a non-paying bidder report and account suspension
5. Seller / Auction House Rules
- • Sellers must accurately describe all items; material misrepresentation is grounds for removal and potential legal liability
- • Items must be shipped within 5 business days of payment receipt
- • Sellers are solely responsible for compliance with all applicable laws, including FFL requirements for firearms transfers
- • Reserve prices, if set, must be honored — listings may not be cancelled after bidding begins without our approval
- • BidderLIVE charges a 5% platform fee on completed sales (see Fees page)
- • Sellers must maintain a connected Stripe account to receive payouts
6. Prohibited Items
The following may not be listed on BidderLIVE under any circumstances:
- • Stolen goods or items with fraudulent provenance
- • Illegal drugs or drug paraphernalia
- • Counterfeit currency, documents, or goods
- • Human remains or protected wildlife products
- • Items that violate any applicable law in the seller's or buyer's jurisdiction
- • Any item we determine in our sole discretion to be harmful or inappropriate
Firearms listings are permitted where legal and must comply with all federal and state regulations. Sellers are responsible for proper FFL transfers.
7. Payments & Disputes
Payments are processed by Stripe. BidderLIVE does not hold funds. In the event of a dispute:
- • Contact the seller first via our messaging system
- • If unresolved within 72 hours, open a dispute through our support team
- • We will review the case and may issue refunds or chargebacks at our discretion
- • Fraudulent chargebacks filed directly with banks without first contacting us may result in account termination
8. Feedback System
After each completed transaction, buyers and sellers may leave feedback. Feedback must be honest and based on actual transaction experience. Feedback extortion (threatening negative feedback to obtain concessions) is prohibited and may result in account suspension.
9. Limitation of Liability
BidderLIVE is a marketplace platform — we are not a party to any transaction between buyers and sellers. To the fullest extent permitted by law, BidderLIVE is not liable for:
- • The accuracy of any listing or seller representation
- • Loss or damage arising from transactions on the platform
- • Any indirect, incidental, or consequential damages
10. Governing Law
These Terms are governed by the laws of the State of [Your State], without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the AAA Commercial Rules, with proceedings conducted in [Your City], [Your State].
